SUBJECT: REIMBURSEMENT OF FEDERAL EXCISE TAX.

Today Nov 23., 2004 I received a letter from Amy Shoenfeld, stating that she called your office and you said you never received a formal request from me regarding this matter. I know you did because you sent me a letter stating I gave you no phone ID number when I did and the signature confirmation of US Mail service verifies this. Further reading of Amy's letter, wherein she states . " Please ensure that you provide your Sprint wireless account number on all correspondence ***."

There in lies the problem. I have no wireless phone. The number I gave you was a land phone and the ID was there. It was 919-000-0000-000 and 919-000-0000-000. I confirmed this was my phone ID number. This is what you have to use to give me credit.

However come time for the December Bill I will not be paying it in total for the next 4 months until the credit of 187 dollars is exhausted as per the agreement of my Fax to you and Len Lauer dated 11-19-04. You and Len had 24 hours to object to the way I was handling the matter and neither of you objected. The maxim of law is silence equates with consent ( "Qui tacet consentire videtur" Broom's Legal Maxims) and Thalheim v State, 38 Fla 169, 192, 20 So.938

So this is your second "Formal Request" to correct your records to eliminate all future Federal Excise taxes from my bills and credit the 187 dollars that I sent you by complete breakdown of all the months the credit should issue. I home you can see that this is a Formal request from me, Albert Harry: coombs.

Since my bill is pretty constant at 43.13, which includes the FET, then just divide 43 into 187 to see how many months I will not be paying until the 187 dollars is deducted. Should the FET still appear on every Bill after November than I will simply add that to the 187 dollars credit.

Now, since I don't have Amy's phone number or fax number, would you bee so kind as to fax this to her and have her e mail me her fax and phone number to bigal123@ncol.net? Also inform Linda Sneed, Sprint Billing Manager in Johnson City by sending her this fax as I do not have her fax number either. She was sent a letter yesterday on the matter.
